Terms of Service

These Terms of Service ("Terms") govern your access to and use of the isburner API, the dashboard at dashboard.isburner.com, and the marketing site at isburner.com (together, the "Service"), operated by ClickOn GmbH, a Swiss limited liability company seated in Zurich, Switzerland ("we", "us"). By signing up or making API requests you agree to these Terms.

1. Account

You must provide a valid email address. You are responsible for keeping your API keys confidential and for all activity under your account. Notify us promptly if you suspect a key has been compromised — you can revoke it from the dashboard at any time.

2. Acceptable use

You agree not to:

  • use the Service to harass, discriminate against, or harm individuals;
  • attempt to reverse-engineer the detection rules, scrape the blocklist, or otherwise circumvent rate limits;
  • use the Service to build a competing email-validation product;
  • process email addresses you do not have a lawful basis to process under applicable data-protection law (see our Privacy Policy);
  • resell raw API responses to third parties without our written consent.

3. Rate limits and fair use

Each subscription tier has documented monthly, daily, and per-minute limits. Sustained traffic that exceeds your plan, or that we reasonably consider abusive, may be throttled or temporarily blocked. We will contact you before permanently restricting access.

4. Suspension and termination

We may suspend or terminate accounts that violate these Terms, fail to pay, or whose activity threatens the integrity of the Service. We will give reasonable notice unless the violation is severe (e.g. abuse, fraud, legal request). On termination we delete or anonymise your data per the retention schedule in our Privacy Policy.

5. Billing

Paid plans bill monthly or yearly in advance via Stripe. Charges are non-refundable except where required by law. You can cancel anytime from the Stripe customer portal linked from the dashboard; access continues through the end of the paid period.

6. Intellectual property

The "isburner" name and logo are trademarks of ClickOn GmbH, and the isburner.com domain (together with all subdomains, including dashboard.isburner.com, api.isburner.com and status.isburner.com) is owned by ClickOn GmbH. The Service, the blocklist, the detection rules, and the dashboard interface remain our property. Nothing in these Terms grants you any right to use the isburner name, logo, or domains except as strictly necessary to use the Service.

You retain ownership of the email addresses and request metadata you submit. Granting us a limited licence to process them is implied by submitting them through the API.

7. Warranty disclaimer

The Service is provided "as is" and "as available". We make no warranty that detection results are accurate for every input, that the Service will be uninterrupted, or that errors will be corrected. Use the API as a signal, not as a sole gate on user-facing decisions.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Governing law and disputes

These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws principles. Disputes are subject to the exclusive jurisdiction of the courts of Zurich, Switzerland, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.

10. Changes to these Terms

We may update these Terms from time to time. Material changes are announced by email to the address on file and by a banner on the dashboard at least 30 days in advance. Continued use after the effective date constitutes acceptance.
